Personal use: Caring for relatives justifies termination 

If someone needs to care for a close relative and would like to move into the same house to do so, they can give notice to the current tenants on the grounds of personal use. This is the result of a ruling by the Munich Local Court (case no. 453 C 3432/21). In this case, a grandniece took legal action against the tenants - an elderly couple - after pre-trial settlement negotiations failed and was ultimately successful.

The grandniece undertook to support her great-aunt and great-uncle (both over 80 years old) with shopping, errands and visits to the doctor. In return, the great-aunt and great-uncle transferred an apartment to her in exchange for a monthly annuity of 800 euros.

She justified the termination for personal use on the grounds that she had to pay EUR 1,300 rent for her 50-square-metre, two-bedroom apartment about three kilometers away, that she had been working from home since before the coronavirus and needed a study, and that she could quickly support her great-aunt and great-uncle in an emergency. The elderly couple who live in the apartment were therefore ordered to move out by the local court.
